At my institution \(and others that I know of\), it’s quite clear: faculty on 12-month contracts are paid for 12 months. Those on 9-month contracts are not.

Understood, and agreed. But I’ll stand by the point I was making: if 40% of your job — and in fact the 40% on which your evaluation most depends — requires the voluntary donation of time during which you aren’t being paid, your workload isn’t really 40/40/20.
